A Florida judge has ruled the property tax measure to raise the homestead exemption is misleading and must be re-written.
The ruling compels Attorney General James Uthmeier to rewrite parts of the proposal for the November ballot.
The judge found the wording of Amendment 3, "Save Our Homes from Excessive Property Taxes," is misleading and biased.
State law requires constitutional amendment language to be clear and neutral.
“For something to be fair… it has to be neutral. It cannot be biased,” said Jamie Cole, a Fort Lauderdale attorney representing several South Florida residents.
Cole says in addition to the title, numerous statements in the ballot summary that are factually inaccurate and must be corrected. He warns if the corrections are not sufficient, voters may never get to vote on Amendment 3.
Election offices must start printing the ballots in late August for it to appear on the ballot in November.
